Your use of the Film in the Netherlands
These terms apply to the use of the Film in the Netherlands website (hereafter referred to as ‘Website’). By using the Website, you accept that you are bound to these terms (‘Terms’). You declare that your use of the Website will comply with the Terms.
The Website provides the possibility to make an account and through that account to make a contribution (‘Contribution’) to the Website. You must keep your log-in name and passwords for this Website confidential. Log-in names and passwords are private. You must not authorise any third party to access your log-in name or password. The personal information that you provide must be accurate, complete and kept up to date.
You agree that, when you use the Website, you will not do anything which violates any of these Terms; nor will you post, upload or transmit any abusive content which we consider to be defamatory, discriminatory, obscene, lewd, offensive, threatening, abusive, harassing, harmful, hateful, as hatespeech, or which contains pornography, content which may be harmful to minors, religious or racial slurs or threatens or encourages bodily harm or the like, or which may violate any person’s rights, regardless of whether such content is accessed, transmitted, propagated, distributed, created or stored in a public or private context; do anything that does not comply with generally accepted internet etiquette; perform system abuse or help any third party to do any of the above.
When, in cases concerning the foregoing, EYE is requested by the proper authorities to make your account and password information available, it will do so. EYE reserves the right at all times to remove a Contribution for any or no reason.
EYE reserves the right – without being required – to make changes to a Contribution from an editorial point of view or as EYE may otherwise see as necessary.
Intellectual property
Works used by EYE on the Website, including texts, photographs and moving images are protected by intellectual property laws. It is not permitted to reproduce or publish these works without first receiving explicit permission from the rights holder, except where permitted in accordance with the Terms and on grounds of imperative law.
Insofar as your Contribution is protected under intellectual property laws, you grant EYE the non-exclusive right to use your Contribution for the realisation of its activities as a museum.
EYE has attempted to contact all copyright holders of works that are published on the Website. If you believe you are entitled to exercise rights over these works please contact EYE via the Contact option (found at the bottom of every page).
Liability and indemnity
You are responsible for your use of the Website and complying with the Terms. You agree to indemnify EYE from any claims or demands from third parties as a result of your use of the Website and/or a violation of the Terms, including violation of intellectual property laws.
EYE has taken great care with regard to the accuracy of the information on the Website. However, EYE cannot be held responsible for possible mistakes, omissions or other incomplete information on the Website, nor for the speed of the Website. EYE is not responsible for:
- damage by or as a result of information on the Website
- the content of websites that are accessed through a hyperlink on the Website
- the availability of and/or the accessibility of the Website.
Privacy
You grant EYE explicit permission to gather and process the personal information that you provide. Your personal information will only be used by EYE to facilitate the functioning of the Website, including the creation of a personal account. Your personal information will not be provided to third parties, unless EYE is legally required to do so. EYE will not use your personal information to promote any of its other products or services.
Participation on the Website can be ended at any time, without having to provide a reason. You can delete your account via Contact. Your request will be processed as quickly as possible by our staff.
General
EYE reserves the right to modify the Terms. Your continued use of the Website after the Terms have been modified constitutes your agreement to be bound by and acceptance of the Terms as they have been modified.
Dutch law applies to the Terms. Any disputes will be submitted to the appropriate court in Amsterdam.
